The Japanese Quasi-Jury and the American Jury - Term Paper spokespersonA body was created to collect views and give recommendations on the approaches to reform the countrys judiciary. The body proposed the establishment of the quasi- instrument panel to try the high-crime cases. The quasi-jury structure was formulated through the typeset Assessor Act the carcass was a concession between the political elements and the conservative individuals. The Supreme Court was opposed to the move to create a jury that was similar to the American jury. Under the law, the infers are required to use the law in the determination of the innocence or guiltiness of an individual as well as give a ruling on the sentence. Moreover, the judges make a determination on matters regarding the interpretation of the laws and decisions beyond the authority of the come in assessors. A presiding judge administers the trial procedures but the statutes of evidence in Japans judicial process are indistinct and simple compared to the procedures in the US. The presiding judge has the authority to limit the number of questions on a witness as well as the determination of the unsuitable evidence given by a witness before a Saiban-in panel. Moreover, the opposing advocate may reject the improper assessment of the evidence. The discussions between the judges and lay assessors demand that legal age as opposed to a unanimous decision. Nonetheless, the composition of the majority must have a professional judge especially when ruling on the guilt of an accused person. The information arising from is regarded as confidential while those leaking the information being subjected to a fine. The composition of the bench and lay assessors is dependent on the situation and the order of the... The legal system in Japan has been largely a civil law since the approval of the Japanese Civil Code in the late 1890s. The system was borrowed from the western nations such as France and Germany. The model persever ed even after the Second World War and the adoption of the contemporary constitution in Japan. The separation of occasion among the various arms of the government is similar to the American model. The judiciary has autonomy like the other arms. In the US, there are divergent procedures in the cases depending on the state although they are largely guided by the constitution. The quasi-jury exercised in Japan has both positive and negative effects depending on the administration. Whereas citizen participation in the judicial process is significant, the established procedures and restrictions are important to assist in getting timely and fair justice. The judicial system in any nation should be informed by the culture of its people and the nature of the governance structures in order to ensure the obligations are met in a desirable approach. It would be to a greater extent desirable if the principles and frameworks of the jury are reformed in line with the demands of the country and th e global environment. Judicial systems are viewed as essential in human-social existence in the society. The Saiban-in system has resulted in minimal effect regarding the prosecution of cases. The system has given the public a dynamic responsibility in the judicial processes, which is likely to make better when the citizens become familiar with the system and the lay judicial involvement.

Renal system Essay Example | Topics and Well Written Essays - 1000 words
Renal system - Essay ExampleIn intrinsic or renal type, structural and serviceable damage of nephrons occurs due to inflammatory, cytotoxic or inflammatory misuses to the kidney. In postrenal kidney injury, there is obstruction to passage of urine. Acute renal tribulation can be oliguric or nonoliguric. In the former type, the daily urine volume is less than 400ml/day. The prognosis in this type is usually poor except in prerenal cases. Urine siding of less than 100ml per day is anuria and occurs when there is bilateral obstruction or injury to both kidneys (Workeneh, and Batuman, 2011). 2. Tests useful in the management of vivid renal failure are serum biochemistries, complete blood picture, urine analysis and urine electrolytes. Ultrasonography is useful is ascertaining the cause of renal failure, especially if the failure is due to obstruction. The hallmarks of acute renal failure are serum creatinine and blood urea nitrogen , both of which are elevated. However, the levels of these substances and the rate of rise depend on the degree of insult to kidneys. It is important to ascertain the ratio of BUN to creatinine. When the ratio is 201, is suggests enhanced absorption of urea, suggesting prerenal injury. BUN may be elevated in other conditions similar gastrointestinal bleeding, steroid administration and loading of proteins. rise of serum creatinine by more than 1.5mg/dL/d warrants evaluation for rhabdomyolysis. Complete blood picture provides an overview of the genus Anemia and leukocytosis. Peripheral smear shows schistocytes in conditions like hemolytic uremic syndrome. Increased formation of rouleax is suggestive of myeloma and the workup must be directed towards serum and urine immunophoresis. new(prenominal) tests which help in detecting the etiology are presence of free hemoglobin, free myoglobin, increased levels of serum uric acid, serological tests like antinuclear antibody, antistreptolysin antibody and serum attendant levels. Urine an alysis is a very useful investigatory tool. In tubular necrosis, granular muddy brown casts will be seen. In well-nigh cases tubular cast cells or oxalate crystals may be seen. Cola colored urine or reddish brown urine is suggestive of hemoglobin. nominal head of evidentiary proteinuria is suggestive of tubular injury. Presence of red blood cells in urine is suggestive of inflammation of glomerulus or bleeding in the collecting system. Presence of white blood cells or their casts in urine is suggestive of acute interstitial nephritis or pyelonephritis. Presence of eosinophils indicates allergic interstitial nephritis (Schrier, 2004). in that location are basically 3 stages of acute renal failure and they are oliguric-anuric phase, early diuretic phase and late diuretic phase. In the oliguric-anuric phase, the urine getup is less than 400 ml/day. There is electrolyte imbalance, metabolic acidosis and raised serum creatinine and blood urea nitrogen. The phase lasts for about 14 days. In the early diuretic phase, the patient passes large volumes of urine, about more than 3000ml per day. This is because the glomeruli are functioning but the tubules are not. The tests reveal electrolyte imbalance, metabolic acidosis and even raised serum creatinine and blood urea nitrogen. In the late diuretic phase, the urine output is still above conventionalism limits. The urine specific gravity is rising. Fluid and electrolyte balances and acid-base balances are within normal limits (Schrier, 2004) 3. More often than not, the only symptoms of acute

Contemporary Human Resourse Management Research Essay
Contemporary Human Resourse Management Research - Essay ExampleWhile professionalization of the HR practice has been encourage through certification programmes such as CIPD, the HR specialists need to add to their attributes to become worthy of the label of being a professional. A model of growth, contribution and enjoyment is what the HR specialists need to focus on. Challenges for the HR specialists Driven by numerous internal and external forces, HR management has expanded its activities from functional and administrative tasks to more strategic functions and aligning its functions and activities with the strategic goals of the composition. A strategic partner should be able to create a positive impact on the organisations performance. The process view of HRM also known as HR system strength or HRS focuses on how the HR function communicates with the employees, not on what it communicates (Rebeiro, Coelho & Gomes, 2011). The HR practitioners are responsible for overall perfor mance in two ways. They shape the skills, attitudes and behaviour of the entire workforce in the organisation which in turn over impacts the organisational performance. Again, the HR practitioners can also have a direct impact on performance by creating structural and operational efficiencies which facilitates the organisation to implement strategies lucid with their goals. This approach requires a strategic fit between the HR practices and the organisational strategy for enhanced performance. HRS has a direct impact on improving behaviour. When messages are communicated to the employees in a clear, consistent and distinct way horizontal fit has been achieved. Organisational culture also impacts the outcome of HR practices. Thus, HR practices and their outcome cannot be considered in closing off because several factors contribute towards its success or failure. Realizing the challenges posed by the changed business environment, the Chartered Institute of Personnel and Development (CIPD) reframed its professional standards and introduced the concept of the thinking doer (Higgins & Zhang, 2009). The thinking performer is an ideal HR practitioner that adds value to their organisation as they are capable of and constantly willing to challenge the way things are executed. The thinking performer is a strategic activist who has the capability to challenge the status quo and demand more from what is currently being delivered by the people in the organisation. CIPD has been attempting to upgrade the personnel management towards strategic issues. This has become essential in light of the fact that most HR practitioners do not engage in strategic issues or challenge how things are being done. However, this too has to be handled in a way that other employees do not feel anomic if the entire focus is shifted towards strategic issues. This is perhaps what Pook (2001) means when he contends that HR development and organisational development are intertwined. People make a n organisation and their knowledge and capabilities are a resource that has to be used for achieving strategically defined results. Much of the business generating activity also depends upon employee loyalty and identification with the organisation. In other lyric poem people are both drivers and inhibitors of change and development. Therefore attracting and retaining the right

Troubling Short and Long-Term Violent Media Effects on Children Essay
Troubling Short and Long-Term Violent Media Effects on Children - show ExampleThe two articles provide compelling evidence that ferocious media has significant short-term and long-term effects on childrens development of aggressive thoughts, emotions, and actions, no matter of gender, socioeconomic status, intelligence, and parenting styles and characteristics. The two articles are similar in examining the effects of violent media on children. Anderson and Bushman conducted a meta-analysis on studies that investigated the impacts of playing video games on aggression, physiological arousal, or prosocial behaviour. They wanted to know if playing violent media is connected to aggressive thoughts, emotions, or actions, or all of the above, and what the underlying mechanisms are for these connections. Huesmann et al. also studied the effect of violent media on children, particularly how watching violent TV in childhood affected later young adult aggression. They conducted a follow-up s tudy of the 1977 longitudinal study that the authors did on 557 children who lived in Chicago. They considered other factors too that can explain the media-behaviour relationship, including preference for violence and third variables. These two articles are both interested in studying the effects of media violence on childrens aggression levels. Though these studies share similar general research topics on violent media effects on children, the two articles are different in their research designs because Anderson and Bushman used a meta-analysis design, while Huesmann et al. continued their longitudinal study.

Lower Alcohol age to 18 Research Paper Example | Topics and Well Written Essays - 3000 words
Lower Alcohol age to 18 - Research Paper Exampless endorsed a law in 1964 obliging states to affix their MLDA to 21 or lose sizeable federal subsidies to construct and develop their public roads (10). All states had satisfied this provision by 1988 (14). But the caput is, was the decision to raise MLDA to 21 an effective one? Or, should MLDA be lowered to 18? This paper tries to answer these two major questions. The purpose of the MLDA is to lower alcoholic drinkic beverage consumption and its related predicaments among adolescents. As mentioned above, in the 1970s, a movement toward lowering the legal drinking age to 18 started in the U.S., presenting numerous natural studies. As an outcome of research findings showing that road accidents among adolescents escalated after lowering of MLDA, a civic attempt was initiated demanding states to increase MLDA to 21 (14). The raise in MLDA throughout unlike states again presented scholars/analysts with a large number of natural studies to evaluate impacts of these policy reforms on alcohol use and associated dilemmas among adolescents (4).In spite of the long history of alcohol consumption laws, the deliberation over MLDA persists. A fraction of this deliberation is whether MLDA of 21 is truly capable of mitigating alcohol-related problems (10). This deliberation is especially important to college campuses or universities for most students on numerous college grounds are below 21 years old. A number of college officials claim that the MLDA of 21 has brought more setbacks on college grounds. However, research findings show that a higher MLDA leads to less alcohol-related problems among adolescents and the age-21 law saves roughly 1,000 young lives annually (13, p. 213). What is interesting is that the impact of the MLDA of 21 is taking place with no or little implementation. A widespread belief among critics of a raised MLDA is that due to the fact that large numbers of teenagers still buy and consume alcohol, an age -21 law is ineffective (13). Yet, according to (9), findings

Chromatography method that measures everything Essay Example for Free
Chromatography method that measures everything EssayYes, it is possible to have a single Chromatography method that measures everything. Chromatography is a laboratory technique that enables separation of mixtures. In most cases, the mixture is dissolved in a fluid and directed to a structure to hold another material called stationary phase. The process whitethorn be analytical or preparative. What is important is the whether the process can separate the mixture for advanced use, professionally called purification or whether the process is attempting to accomplish little separation process. Zhang (2007, p. 247) attempts to argue for the possibility of single chromatography it is suggestive to apply separation including LC and GC. This allows the separation to occur in stages, primarily, the stationary phase, where the substance is held in a destine tube through and the mobile where the liquidized substance is held under low pressure. Zhang proposes the use of planer chromatogra phy. This technique endeavor uses flat surface, where the substance component is spread. The technique is legal since it allows different compounds to respond to different distances according to how they significantly interact at the stationary phase. Also, this technique uses the retardation factor (IUPAC, 2006), which is distance travelled from the center of make love to the solvent front, where the substance is separated completely. However, for more complex substances, it is good to use a Universal Chromatography interface (UCI) device. This device allows the usage with Chromatography Management, which establishes a hybrid ground analytical mechanism combining various Chromatographic devices. Essentially, the device control is through four ports known as RS-232 ports with eight contact-closure relay as rise up as, eight TTL inputs aided through a computer communication mechanism (Ottosen, Grout Mller, 2009). Technically, the device accepts analogue from multiple detectors fr om high performance electronics by ensuring accurate signal measurement. In encapsulation, a UCI combines various technologies in one simpler purification process.ReferencesZhang, C. (2007). Fundamentals of Environmental Sampling and Analysis. Dramatic devices Essay Example for Free
Dramatic devices EssayCompare and contrast the characters of Inspector Goole and Mr Birling in Act One. How does J.B Priestly utilization dramatic devices to help shape an auditions response to views presented in this play.J.B Priestlys play was set in 1912 but written in 1945. The President at the time was c onlyed Herbert Asquith. The large was built and nicknamed, The Unsinkable. It crashed on its first commercial journey on an iceberg and sunk, more than a hundred were unfound. It was just before World War 1 broke out against Germany. In 1945, World war 2 had just ended. Thousands upon thousands had perished in the war and the country was grieving its vast loses, still pondering the exorbitant situation upon which they had been left in. The country was brought together in sadness and grieving.Britain in 1912 was a nation divided by class. meagerness was no longer the jailbreak of the poor but the open frame of society Britain had created. While the poor suffered, the r ich and middle class enjoyed a lifestyle which even people today would envy. Poverty ravished the country. This was made to a great extent worse by World war 1 and 2.Priestly, through this play was trying to show the appalling fault of society. The extremes and ignorance of the Capitalist views and that unless it stopped this build of poverty and war would continue happening. He was trying to convey to the audience his Socialist views. By undertaking this, he could lineation all the negative points of Capitalist ideas and at the same time highlight all the good points well-nigh the Socialist ideas, effectively demonstrating the potential of Socialist views and subconsciously allowing people to think twice about Capitalism. The Inspectors name, Goole, is a dramatic device used in order to express to the audience that there is a kind of mysterious nature about him. The Goole name relating to such as a ghost as it sounds a lot like ghoul. This is very ironic, as he seems to act this ve ry well. Goole is also a seaport town, this can be linked with the referral to fish for information. He is fishing for information from the Birling family. He is a great deal like Eva Smith, just an separate face in the crowd, common. This links with the name Smith it is a very common name. Eve was the very first women in the Bible and is represented in that way as being very innocent and is an innocent victim in this proposition. She is representing society and all the oppressed victims. This associates with the free burning repetition of A lot of these young women by the Inspector which further hints to what or who Eva Smith represents. He also seems to be omniscient about the matter of Eva Smith. Almost intimidating at times. None of the Birling family is sure how much he already knows, but all the same he still drags the up properlyness from them. The Inspector is not a big man and need not be a big man as he creates at in one case the impression of massiveness, solidity and p urposefulness. He is in his fifties and dressed in a plain darkish suit of the period. Priestly introduces him as a passe-partout person. A person who is going to make an impact even before he has spoken based purely on his appearance. Because of the Inspectors appearance it gives a que for everyone including the audience to take him seriously. His appearance alone demands respect. He comes across as being very professional, organised and thus good at his job. He is talked about by Sheila as if you cannot trick him. He will find out what he does not already know. The Inspector is the catalyst in the play. He speeds up all the confessions of the characters in the play by the belief of the other characters that he already knows everything and he tries to make them change in order to help society. On the other hand, Arthur Birling is aHeavy looking very portentous man in his middles fifties with fairly easy manners but rather tyke in his speech. The spotlight is immediately taken off M r Birling when the Inspector walks in and this discomforts him. The Inspector looks somewhat superior to Mr Birling. Mr Birling hates this as he demands genial status because of how rich he is. He tries very hard to gain social superiority but lacks refinement. Tell the cook for me It is bad manners to chin-wag on the food at your own house, Mrs Birling says to him Arthur you must not say such things. As you can see by this, Mrs Birling is Mr Birlings social superior. This is ironic as he is trying to depict himself as a person of high social status but it has already been seen by his actions and what he says that he is not of high social status, he lacks the correct mannerisms. The effect of this is that he is made to look dim-witted and the audience would not look to him as being a superior man to the inspector but the same underneath. The inspector speaks like a judge or prophet. He continually makes comments about the actions of the characters in the play. The Inspector seems to care a lot about other people. He believes everyone should act as a community and all have obligation for their actions against anyone. This is in deep contrast to the morals of Mr Birling. Mr Birling thinks that he has no responsibility over his employees. If he fires them then it is their responsibility what they do. He is very right wing in his thinking and does not believe that everyone is equal.
